Federal law prohibits the sale of closed system devices (pods, cartridges, etc.) containing e-liquid in flavors other than tobacco or menthol. On January 21, 2020, Governor Murphy signed S3265, prohibiting the sale of all flavored vapor products (including menthol) except tobacco flavor. The law took effect on April 20, 2020. Members of the public are encouraged to report the sale of flavored tobacco and vape products to the Middletown Township Health Department.

“Smoking Prohibited” includes Vaping
In January 2010, New Jersey passed a law which bans the use of “electronic smoking devices” in public places and workplaces (amended the 2006 NJ Smokefree Air Act), which includes all Middletown government offices, property, public parks, recreations areas, and beaches. Also included is any commercial location, such as an outdoor restaurant, with a “No Smoking” policy. Individuals who smoke/vape in areas where it is prohibited risk being fined.
