Preventing the Sale to Individuals Under the Age of 21

As of November 1, 2017, the legal age for purchasing tobacco products and electronic smoking devices in New Jersey is 21. Raising the minimum age from 19 to 21 helps protect young people from the deadly effects of tobacco use. New Jersey is the third state in the nation to raise the smoking-purchase age to 21, following Hawaii and California.

To that end, Middletown Township requires all smoke shops to check the ID of all patrons at point of entry. All businesses that sell other items in addition to vape products must check IDs at point of sale of any vape or e-cigarette product.

All businesses licensed by the Middletown Township Health Department have been provided "21 and over" signage and are required to properly display it on their entry door. Failure to properly display the signage will result in a temporary license suspension or permanent revoking.

The physical licenses granted to commercial establishments are also required to be displayed in public view and are to be willingly shown to any individual who may request to see it.

Any member of the public who would like to report the non-display of a license and/or "21 and over" sign can report their concern to the Health Department.
